OSHA has published its final rule to adjust for inflation the civil monetary penalties assessed and enforced, according to a news release from the agency. The Department is required to adjust penalty levels for inflation to comply with the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 by no later than January 15 of each year.
The publication of inflation adjustments were delayed due to a “lapse in appropriations funding for certain government agencies,” according to the news release. The agency has proposed the following maximum penalty amounts for 2019 upon publication in the Federal Register:
- $13,260 per violation for violations classified as “Serious,” “Other-Than-Serious,” or “Posting Requirements;”
- $13,260 per day beyond abatement date for “Failure to Abate” violations; and
- $132,598 per violation or “Willful or Repeated” violations.
